This site is operated by Midsummer Barns, which is part of RJS & DM Addison, a business registered to Greystone House, Kings Meaburn, Penrith, Cumbria, CA10 3BU

Any Content (including text, graphics, photographs, drawings) that you access on this Site is owned by us (or third parties who license such Content to us) and is made available only for your own personal use on the condition that you must not republish, post, transmit, edit, adapt, syndicate or distribute any Content without our prior written permission. The names ‘Midsummer Barns’, ‘Moon Barn’, ‘Dove Barn’ and other business names and logos displayed on this Site may be trademarks belonging to us.
To the maximum extent legally permitted, you cannot link to or seek to extract data from this Site or re-utilise any part of this Site or Content for any commercial purpose or use our trademarks in a way that suggests that you or your business has any endorsement from or affiliation to us without our prior written permission (at our sole discretion).
This Site may link to third party websites from time to time. These links are provided for your convenience only. We do not control third party websites and are not responsible for their contents or how they operate. Where this Site includes any links to third party websites, this does not imply any endorsement by us of the goods, services or materials made available on such websites. You acknowledge that (to the maximum extent legally permitted and unless we state otherwise) we shall not be liable in respect of your use of those third party websites or any purchase you make through them.

You must only use this Site for legal purposes in accordance with these Terms and are prohibited from using our Site to engage in any fraudulent activity or in a manner that (in our reasonable opinion) is liable to damage our business or harm other users. Your use of our Site is subject to other policies or guidelines that we may communicate to you from time to time.
You also undertake that any personal data and other information you may provide to us when registering or signing up to any services on this Site is complete, accurate and up to date. In relation to any material you submit to us or post on this Site, you undertake to us that either you own this material or have the necessary rights, clearances and or approvals you need to submit or post such material.
You agree to compensate us in relation to any third party legal actions or claims that are made against us and for any associated losses, damages or expenses (including any legal expenses) that we suffer as a result of you breaching your obligations or undertakings in this Section 4.

We do not accept any liability for damage to any computer or device that you use to access this Site or in relation to any loss of data when you use this Site. In addition, we cannot guarantee that any Content you access or download is free from viruses, worms or other malware, and you should check that you have suitable, up to date virus or malware protection on your computer or device.
While we will correct any errors on this Site that come to our attention as soon as we reasonably can, we do not undertake or warrant that this Site or the Content will be completely free from bugs or errors or that this Site will be available on an uninterrupted basis. When you provide it to us (e.g. by contacting us when making a booking, by booking a stay through our website or a third party booking channel, in person during your stay and or by signing up to our newsletter);
From third parties who may contact us in order to make a booking on your behalf;
From your use of our website, using cookies, Google Adwords and Facebook custom audience targeting.
7. What personal data may we collect?
We may collect the following personal data about you:
Personal contact details (such as name, home address, email address; business address and phone number);
Additional personal details you choose to provide us with when corresponding with us by phone, e-mail, through this Site or when you visit our premises, which relate directly to your booking;
Information about your debit/credit card and or bank account information that we require for the purpose of recording and processing your booking. For further details please also refer to the section below headed “Payment information”.
Data about your use of our website and services, such as: IP address, geographical location, browser type and version, operating system, referral source, length of visit, page views and website navigation paths, as well as information about the timing, frequency and pattern of your service use.
8. How we use your data
We may use your personal data in the following ways:
For administrative and business purposes directly relating to a contractual agreement that we have with you.
To administer our Site and ensure that our Site is presented in the most effective manner for you and for your computer/device. Data will be used in this way in so far as it is necessary for our legitimate interests.
For internal business/technical operations, including troubleshooting, data analysis, testing, research, statistical and survey purposes and as part of our efforts to keep our Site secure. Data will be used in this way in so far as it is necessary for our legitimate interests.
For advertising on third party websites (including Google) to previous visitors to this Site. Data will be used in this way in so far as it is necessary for our legitimate interests.
To send out newsletters to opted-in subscribers. We will only process your personal data in this way where your consent has been given enabling us to do so.
9. Newsletter
Contact information will be retained and used from opted-in subscribers who have given their consent, to enable us to provide updates, send out newsletters and other marketing material relating to Midsummer Barns.
10. Cookies and Google Ads
Our Site stores a number of different cookies on the computer or device that you use to access our website. Cookies are small text files used by browsers to store small bits of information about a device or computer, such as preferred settings or preferred languages.
Cookies do not take up much space (unless you have thousands of them) and cannot contain viruses or other harmful code.

On our website we never use category 4 cookies, which are the only cookies that are likely to track your behaviour across multiple websites. Our Site uses the Google Ads marketing service to advertise on third party websites (including Google) to previous visitors to this site. It could mean that we advertise to previous visitors who haven’t completed a task on our site, for example using the contact form to make an enquiry. This could be in the form of an advertisement on the Google search results page, or a site in the Google Display Network. Third-party vendors, including Google, use cookies to serve ads based on someone’s past visits to the Midsummer Barns website. Any data collected will be used in accordance with our own privacy policy and Google’s privacy policy.
You can set preferences for how Google advertises to you using the Google Ad Preferences page, and if you want to you can opt out of interest-based advertising entirely by cookie settings or permanently using a browser plugin.
11. Disclosure of information to third parties
We will only disclose your information to the extent necessary:

We will keep your data for no longer than necessary, taking into account any legal obligations we have (e.g. to maintain records for tax purposes) and any other legal basis we have for using your personal data.
13. Payment information
Any credit/debit card payments and other payments you make through this Site will be processed by our third party payment provider. The payment data you submit will be securely stored and encrypted by our payment service provider using up to date industry standards. Please note, we do not ourselves directly process or store the debit/credit card data that you submit.
We may arrange that the card or payment data you submit is stored for the purpose of processing your booking and collecting the payment. Please note, this data may be stored for future use.
We may also store and use this card or payment information for the purpose of processing any future payments that you make for additional goods and services. We will store this data in accordance with our legal obligations under applicable law and only for so long as legally permitted.
You may choose to opt-out of us holding your card or payment data although this means that you will need to re-supply us with card/payment details for any future bookings.
14. Security
The personal data that we collect from you may be transferred to and stored at a destination outside the European Economic Area (“EEA”) such as by our subcontractors in the United States who process your payment details and/or provide IT support services. In accordance with applicable law, we will do everything we reasonably can to make sure that those subcontractors comply with appropriate security standards to protect the personal data that they handle.
Please note that the US and certain other countries outside the EEA do not provide the same legal standards for protection of your personal data that you have in the United Kingdom or EEA. By submitting your personal data, you agree to the transfer and processing of your personal data outside the EEA for the purposes set out in this Privacy Policy.
Unfortunately, the transmission of information over the internet or public communications networks can never be completely secure. We will take appropriate technical and organisational security measures to protect the personal data that you submit to us against unauthorised/unlawful access or loss, destruction or damage, although we cannot 100% guarantee the security of data that you provide to us online.

You have a right to access a copy of the Data which we hold about you. If you would like to do this, please email us at caroline@midsummerbarns.co.uk putting the subject matter in the email header, or write to us at Midsummer Barns, Kings Meaburn, Penrith, Cumbria, CA10 3BU. Any subject access request may be subject to a small fee to meet our administrative costs. We may also need to ask you for further information to verify your identity before we can respond to any request. We will provide your Data within thirty (30) days of receipt of your written request and payment of any necessary processing fee.
You have a right to have any inaccurate personal data about yourself rectified and, taking into account the purposes of the processing, to have any incomplete personal data about yourself completed. You are able to request that amendments be made to your personal data, either by informing us in person, over the telephone, or contacting our Data Processor in writing or via email at caroline@midsummerbarns.co.uk.
In some circumstances you have the right to have your personal data erased, without undue delay. These circumstances include:
When your personal data is no longer necessary for the purposes of enabling us to conclude our contractual agreement with you;
When you withdraw your consent to consent-based processing;
